Terms of Service
These terms govern access to and use of the BotFrame software product and hosted service.
1. BotFrame, the Supplier, and these terms
“BotFrame” is the name and brand of the software product and hosted service described on botframe.dev. It is not represented in these terms as a separate incorporated entity. References to “we”, “us”, “our”, or the “Supplier” mean the individual supplier who owns and provides the BotFrame product. “Service” means the BotFrame websites, application, APIs, editor, simulator, hosted runtime, AI-assisted features, infrastructure, and related functionality.
By creating an account, accessing or using the Service, or obtaining a paid entitlement, you agree to these Terms of Service and acknowledge our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must meet Discord’s applicable minimum age requirement and be legally permitted to use the Service where you live. If applicable law requires a parent, guardian, employer, organisation, or other person to authorise your use or purchase, you must obtain that authorisation before using the Service.
Customer authentication is provided through Discord OAuth. You are responsible for maintaining control of your Discord account, securing devices and credentials used to access BotFrame, keeping relevant account information accurate, and promptly notifying us if you suspect unauthorised access.
Accounts and entitlements are personal to the authorised account holder unless we expressly support another arrangement. You may not sell, transfer, share, automate, or multiply accounts to defeat plan limits, eligibility requirements, security controls, or billing restrictions.
3. Access licence and the Service
Subject to these terms and any applicable plan limits, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service for its intended purpose. No ownership of BotFrame software, infrastructure, schemas, models, systems, source code, or other Supplier materials is transferred to you.
Features may include a visual workflow editor, revision history, validation, simulation and testing, AI-assisted generation or editing, managed deployment, Discord gateway or interaction handling, runtime execution, hosting, usage reporting, and related functionality. Features, limits, availability, technical implementation, and supported configurations may change over time.
The Service is not a data-storage, archival, escrow, disaster-recovery, or backup service unless a separate written agreement expressly says otherwise. Export functionality may be limited or unavailable.
4. Your Discord applications, responsibilities, and Customer Content
You must only connect Discord applications, bots, servers, credentials, data, and other resources that you own, control, or are authorised to administer. You remain responsible for your Discord application, its permissions, its operation, the servers in which it is used, the workflows you configure, and actions it performs.
“Customer Content” means content, data, instructions, prompts, project names and descriptions, workflows and revisions, simulator documents, test material, configuration, custom material, messages or values submitted to configured workflows, and other material that you or your authorised users submit to, create in, or cause to be processed by the Service.
You retain ownership of any rights you already hold in Customer Content. You represent and warrant that you have all rights, permissions, notices, and lawful authority necessary to submit and process Customer Content as contemplated by these terms, including where it contains material or personal information relating to another person.
5. Licence to Customer Content; analytics and model development
You grant the Supplier and its service providers a worldwide, royalty-free, non-exclusive, sublicensable licence to host, copy, reproduce, transmit, transform, adapt, analyse, label, evaluate, display where necessary, create technical or analytical derivatives from, and otherwise process Customer Content for the purposes of operating, securing, supporting, testing, researching, developing, maintaining, and improving BotFrame and related products, services, automated systems, and machine-learning or artificial-intelligence models.
This licence includes using eligible Customer Content and service interactions to train, fine-tune, evaluate, benchmark, or improve machine-learning and AI systems. This may include prompts, workflows, configuration, simulator material, generated outputs, feedback, and other content processed through the Service. We may use human review and third-party processors for these purposes where appropriate. We do not intend to use authentication secrets such as Discord bot tokens or full payment-card information as model-training content.
Unless an applicable law requires otherwise, you are not entitled to royalties, fees, attribution, or other compensation for these uses. If we offer a training opt-out or similar control, its stated scope applies prospectively; it does not require us to reconstruct or retrain models, remove information already incorporated into model parameters or derived datasets, or delete de-identified or aggregated information, except where applicable law requires us to do so.
The licence survives termination to the extent reasonably necessary for backups, security records, legal compliance, de-identified or aggregated datasets, evaluation material, model parameters, derived analytics, and other material that cannot reasonably be separated from systems developed using Customer Content. Nothing in this section overrides mandatory privacy, data-protection, intellectual-property, or consumer rights.
6. Discord end-user data
Your bot may process information relating to Discord users who are not BotFrame customers. You are responsible for determining what data your bot collects, what permissions it requests, and whether you have a lawful basis, notice, consent, or other authority required for that processing. You must not use BotFrame to collect or process information in a manner that violates law, Discord policy, or another person’s rights.
We may process end-user data as technically necessary to execute configured workflows, operate and secure the Service, diagnose problems, prevent abuse, and perform other processing described in our Privacy Policy. You should not configure workflows to collect sensitive, confidential, or unnecessary personal information unless you have determined that doing so is lawful and appropriate.
7. Credentials and third-party integrations
BotFrame may require Discord bot tokens, application identifiers, public keys, webhooks, or other credentials to provide particular features. We may apply encryption, access controls, or other safeguards, but no credential-storage system is guaranteed to be invulnerable. You are responsible for rotating credentials when appropriate and for losses arising from credentials that you expose outside the Service.
The Service depends on third parties including Discord, hosting providers, AI providers, and Paddle. Their outages, API changes, rate limits, policy decisions, account actions, security incidents, or discontinued functionality may affect BotFrame. We are not responsible for third-party services and do not guarantee continued compatibility with them.
8. AI-assisted and automated features
BotFrame may use Supplier-operated or third-party AI systems to generate, revise, analyse, test, or explain workflows and related material. Relevant prompts and project context may be processed by those systems. AI-generated content can be inaccurate, incomplete, unsafe, non-unique, infringing, or unsuitable for your intended use.
You are solely responsible for reviewing, testing, validating, and deciding whether to use AI-generated or automatically generated material. We do not warrant that an output is correct, unique, legally usable, free from third-party rights, or fit for deployment. Similar or identical outputs may be provided to other users.
You must not intentionally submit secrets, payment credentials, regulated data, or sensitive personal information to AI features unless the feature requires it and you have lawful authority to do so.
9. Free plans, paid entitlements, and usage limits
BotFrame may offer free access and paid entitlements with different limits for bots, servers, member scope, hosting, gateway presence, execution capacity, storage, AI use, or other resources. The current commercial terms presented on the pricing page or at checkout form part of the applicable product description.
Any “unlimited” description is subject to technical capacity, fair-use controls, abuse prevention, reasonable rate limits, third-party platform restrictions, and measures required to protect service stability or other users. We may throttle, queue, rate-limit, shed, restrict, or suspend workloads that materially affect reliability, security, cost, or capacity.
Usage and entitlement calculations may be based on our service records, telemetry, counters, Discord-reported information, or Paddle subscription state. Reasonable technical discrepancies do not create an entitlement to additional capacity, credits, or refunds.
Free, promotional, beta, trial, preview, and experimental features may be changed, limited, suspended, or withdrawn at any time without compensation. Unless expressly stated in writing, no service-level agreement, uptime commitment, support response time, or resolution time applies.
10. Purchases, subscriptions, and Paddle
Our order process for paid BotFrame access is conducted by Paddle.com, our authorised reseller. Paddle.com is the Merchant of Record for paid orders and is the seller to the Buyer for the transaction. Paddle handles payment collection, applicable transaction taxes, payment-related buyer support, cancellations, chargebacks, and refund processing. The Supplier provides and fulfils access to the underlying BotFrame product.
Paid subscriptions renew automatically for the billing period shown at checkout until cancelled. Pricing, billing frequency, currency, taxes, renewal terms, and other transaction details are presented by Paddle before purchase. You must manage payment and subscription changes through the methods Paddle makes available.
Paddle’s Buyer Terms and Refund Policy govern the transaction in addition to these terms. The Supplier cannot guarantee that Paddle will approve or decline any particular refund, dispute, chargeback, tax adjustment, or payment method.
11. Cancellation, expiry, downgrade, and data above plan limits
Cancellation ordinarily prevents future renewal and takes effect as provided by Paddle. Unless Paddle, applicable law, or an express written offer says otherwise, cancellation or downgrade does not create a pro-rata refund, credit, or cash value for unused time, unused quotas, inactive bots, or unused features.
When a paid entitlement expires, is refunded, is reversed, is downgraded, or otherwise ends, features and resources exceeding the then-current entitlement may be disabled, stopped, made inaccessible, archived, or deleted. This may include deployments, revisions, simulator data, stored configuration, logs, generated material, or other Customer Content.
We do not promise to retain data that exceeds your current plan after a downgrade or paid entitlement ends. We may provide a grace period, selection mechanism, recovery process, or temporary retention, but we are not required to do so unless applicable law or a separate written commitment requires it. Data may become permanently unrecoverable without further notice after the applicable entitlement ends.
You are responsible for reducing usage before a downgrade, preserving independent copies of information you need, and not relying on BotFrame as your sole copy of important material. The presence of information in a backup does not create an obligation to restore it for you.
12. Acceptable use
You must not use BotFrame to violate law, Discord policy, another person’s rights, or the security or integrity of any system. You must not expose the Supplier, Paddle, service providers, Discord, customers, or third parties to unreasonable legal, security, financial, or operational risk.
Prohibited conduct includes distributing malware; credential theft; phishing; unlawful or abusive spam; evading platform enforcement or rate limits; unauthorised access; harassment, exploitation, or threats; infringement of intellectual-property or privacy rights; illegal gambling; unauthorised regulated financial activity; denial-of-service activity; unauthorised security testing; scraping or reverse engineering except where law expressly permits it; and deliberately abusive consumption of resources.
You must not bypass or attempt to bypass plan limits, billing controls, security controls, execution limits, tenancy boundaries, rate limits, access restrictions, safety mechanisms, or capacity controls.
13. Service changes, maintenance, and experimental functionality
We may alter the Service’s architecture, interfaces, node behaviour, models, limits, providers, supported APIs, storage formats, or other implementation details. We may remove or replace functionality where reasonably necessary for security, law, third-party compatibility, capacity, cost, product development, or sustainable operation.
Maintenance, deployment, capacity controls, security events, provider failures, or third-party restrictions may interrupt or degrade the Service. Deployments may be queued, restarted, migrated, rate-limited, or stopped. We do not guarantee uninterrupted availability, message delivery, command delivery, gateway presence, data persistence, or compatibility with every Discord configuration.
Beta, preview, experimental, and AI functionality may be incomplete, unstable, materially changed, or discontinued and may cause loss of associated data. You use such functionality at your own risk.
14. Suspension and termination
We may suspend, restrict, quarantine, or terminate access to an account, project, credential, deployment, feature, or workload if we reasonably believe it is necessary to address abuse, security risk, suspected fraud, non-payment, excessive resource use, legal exposure, a breach of these terms, a third-party requirement, or a risk to the Service or others. We may act without prior notice where delay could increase risk or where notice is impracticable or prohibited.
We may terminate free, trial, beta, preview, or promotional access at our discretion. If we permanently discontinue a paid product before the end of an already-paid period, any remedy will be determined under Paddle’s applicable terms, mandatory law, or any remedy we expressly offer.
Termination or deletion may result in immediate loss of access to Customer Content and hosted resources. We have no obligation to provide continued access, migration assistance, or data export after termination except where applicable law requires it.
15. Supplier intellectual property and feedback
The BotFrame name and branding, websites, interface, editor, node system, product design, templates, schemas, documentation, software, hosted runtime, models, prompts, methods, and other Supplier materials are owned by the Supplier or its licensors and are protected by applicable intellectual-property laws. Except for the limited access right in these terms, no rights are transferred to you.
You may not copy, resell, sublicense, reproduce, scrape, reverse engineer, extract, or commercially exploit Supplier materials except where expressly permitted by law or a separate written agreement.
If you provide ideas, suggestions, bug reports, feature requests, evaluations, or other feedback, you grant the Supplier a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialise, disclose, and incorporate that feedback without restriction or compensation to you.
16. Privacy, security, backups, and confidentiality
Our Privacy Policy describes how information is collected and processed, including uses relating to AI and service development. You are responsible for the privacy and data-protection obligations arising from your own bot configuration and use of Discord data.
We use technical and organisational safeguards intended to protect the Service, but no online system is completely secure. We do not warrant that Customer Content, credentials, or service data will never be lost, corrupted, accessed, disclosed, or unavailable.
Backups, replicas, logs, snapshots, and disaster-recovery systems are maintained for our operational purposes and are not a customer backup service. We do not guarantee point-in-time recovery or restoration of any particular Customer Content.
Unless we separately agree in writing, use of the Service does not create a fiduciary duty or a special confidentiality obligation beyond obligations imposed by applicable law and the commitments expressly stated in our Privacy Policy.
17. Indemnity
To the maximum extent permitted by law, you are responsible for claims, losses, liabilities, costs, and reasonable expenses arising from your Customer Content, your Discord application, your violation of law or third-party rights, or your material breach of these terms. Where legally enforceable, you agree to indemnify the Supplier against such amounts to the extent they result from your acts or omissions rather than the Supplier’s own wrongful conduct.
18. Mandatory rights and disclaimers
Nothing in these terms excludes, restricts, or modifies a guarantee, warranty, right, remedy, or liability that cannot lawfully be excluded, restricted, or modified. Mandatory consumer rights continue to apply where applicable.
Subject to those mandatory rights, the Service and all outputs are provided on an “as available” and “as is” basis. To the maximum extent permitted by law, we disclaim implied warranties and do not warrant uninterrupted operation, error-free functionality, permanent storage, complete security, fitness for a particular purpose, compatibility with every third-party service, or that any workflow, AI output, simulation, validation result, or deployment will produce a particular outcome.
19. Limitation of liability
To the maximum extent permitted by law, the Supplier is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, goodwill, opportunity, business interruption, Discord access, third-party accounts, or data, arising out of or relating to the Service.
To the maximum extent permitted by law, the Supplier’s aggregate liability arising out of or relating to the Service during any twelve-month period is limited to the amount actually paid for the affected BotFrame product through Paddle during the three months immediately preceding the event giving rise to the claim. If no amount was paid during that period, the aggregate cap is AUD $50.
The limitations in this section do not apply to liability that applicable law does not permit to be excluded or capped and will be reduced or adjusted only to the minimum extent necessary to comply with that law.
20. Changes to these terms and the Service
We may update these terms from time to time. Changes will be posted with a revised “last updated” date and may take effect immediately where required for law, security, abuse prevention, third-party requirements, or changes that do not materially reduce an existing paid entitlement.
For other material changes affecting an existing paid subscription, we will provide notice where required by law or reasonably practicable. If applicable law gives you a right to reject a material change, your available remedy may include cancelling future renewal before the change takes effect.
21. Transfer and severability
You may not assign or transfer your rights under these terms without our consent. We may transfer these terms, Customer Content licences, and associated rights and obligations as part of a sale, transfer, restructuring, succession, or change in ownership or operation of the BotFrame product, subject to applicable law.
If a provision of these terms is found invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will continue to apply.
